General Terms and Conditions of Sale

These terms and conditions of sale are established between, on the one hand, the company MizouTCG, a micro-entrepreneur not subject to VAT, registered under SIRET number 903 542 165 00019 with its registered business address at 26 rue Bastard Senaux 34320 Roujan, hereinafter referred to as "MizouTCG", and, on the other hand, any natural or legal person making a purchase through the website mizoutcg.fr, hereinafter referred to as "the customer".

Article 1. Purpose

These terms and conditions of sale are intended to establish the contractual relationship between MizouTCG and the customer, as well as the terms applicable to any purchase made through the website mizoutcg.fr. Purchasing an item on this website implies the customer's full and unreserved acceptance of these terms and conditions of sale, which the customer acknowledges having read before placing an order. Prior to any transaction, the customer declares, on the one hand, that the acquisition of products on the mizoutcg.fr website is unrelated to any professional activity and is limited to strictly personal use, and, on the other hand, that the customer has full legal capacity to enter into commitments under these general terms and conditions of sale.

MizouTCG reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its website. Consequently, the applicable conditions will be those in force on the date the customer places an order.

Article 2. Products

The items offered are those listed on the mizoutcg.fr website, subject to available stock. MizouTCG reserves the right to modify its product range at any time. Each item is presented on the website with a description detailing its main technical characteristics. Images are as accurate as possible but are not binding on the seller, particularly regarding exact colour shades.

Article 3. Pricing

Prices shown on the product pages of the online catalogue are expressed in Euros (€) and are net prices, MizouTCG not being subject to VAT in accordance with item 293 B of the French General Tax Code (CGI). MizouTCG reserves the right to modify its prices at any time, it being understood that the price displayed in the catalogue on the date of the order will be the only price applicable to the customer. The prices stated do not include delivery charges, which are invoiced in addition to the price of the purchased products according to the total order amount.

Article 4. Order and payment terms

Before placing any order, the customer must create an account on the mizoutcg.fr website. The account creation section is directly accessible from the side menu. On each visit, the customer wishing to place an order or access their account (order status, profile, etc.) must identify themselves using their personal information. MizouTCG offers the customer the ability to order and pay for products in several steps, with different payment options.

The customer selects the products they wish to purchase in the "cart", adjusts if necessary (quantities, references, etc.), and verifies the delivery address or enters a new one. The shipping costs are then calculated and presented to the customer, along with the name of the carrier. The customer then chooses their preferred payment method. The next step allows the customer to review all information, read and accept these general terms and conditions of sale by checking the corresponding box, and confirm their order by clicking the "Confirm my order" button.

The customer then chooses their payment method: in person, PayPal, or bank card. For online payments, they will be redirected to the secure PayPal interface to safely enter their PayPal account details or personal bank card details. If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by PayPal account or bank card is irrevocable.

Validating an order entails acceptance of these terms and conditions of sale, acknowledgement of having full knowledge of them, and waiver of the right to rely on the customer's own purchasing conditions. All data provided and the recorded confirmation will constitute proof of the transaction. MizouTCG will notify the customer by email of the confirmation of their order at the address provided when creating the customer account. Upon the customer's request, an invoice in PDF format will be sent to them.

Article 5. Retention of title

MizouTCG retains full and complete ownership of the items sold until full payment of the price, including the principal and any charges.

Article 6. Right of withdrawal

In accordance with items L. 221-18 and following of the French Consumer Code, the customer, as a non-professional natural person, has a period of fourteen (14) calendar days from receipt of their order to exercise their right of withdrawal, without having to justify any reason or pay any penalties.

The customer must notify their intention to withdraw by contacting the seller in writing (by email or post) and by returning the product in new, complete condition in its original packaging. Return shipping costs are the customer's responsibility, unless otherwise indicated.

MizouTCG will refund the total order amount (including the initial delivery charges, excluding any surcharge for a specific delivery method chosen by the customer) within fourteen (14) days of receipt of the returned product, subject to compliance.

Exceptions to the right of withdrawal

In accordance with item L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to:

  • Individual cards and second-hand products, which are considered personalised goods or whose condition may vary after use.
  • Sealed products (boxes, boosters, etc.) that have been opened, as their random contents and their sensitivity to handling prevent them from being resold under identical conditions.

Any return that does not comply with these conditions may be refused or subject to a reduction in the refund based on the condition of the returned product.

In accordance with legal obligations, the customer may exercise their right of withdrawal using the form below or by sending a clear statement by post or email.

Article 6 bis. Pre-orders

6.1. Definition

A pre-order is an order placed for a product that is not yet available in stock at the time of the order. Pre-order products are clearly identified as such on the website with the label "Pre-order" or "Available for Pre-Order" and the estimated availability date.

6.2. Customer commitment

By placing a pre-order, the customer makes a firm commitment to purchase the product. Validating a pre-order entails acceptance of these specific conditions and constitutes a firm and definitive purchase commitment.

6.3. Payment

Full payment for the pre-order is required at the time the order is validated. The amount will be immediately debited from the customer's account according to the chosen payment method.

6.4. Cancellation by the customer

⚠️ Pre-orders cannot be cancelled by the customer after payment has been validated. No refund will be issued in the event of customer withdrawal, except in the following cases:

  • Delivery delay of more than three (3) months beyond the initially announced availability date, following a formal notice that has remained without effect for fifteen (15) days.
  • Cancellation of the product release by the manufacturer or publisher.
  • MizouTCG's definitive inability to obtain the product.

6.5. Delivery date

The estimated availability date communicated on the product page is given for information purposes only and does not constitute a contractual commitment under any circumstances. MizouTCG endeavours to adhere as closely as possible to the announced dates, but cannot be held liable for delays attributable to manufacturers, publishers, distributors, or carriers.

The customer will be notified by email of any significant change to the planned availability date. In the event of a delay of more than three (3) months, the customer may request the cancellation of their pre-order and obtain a full refund of the amounts paid.

6.6. Shipping

Pre-ordered products will be shipped as soon as they are received in stock by MizouTCG, in the chronological order of recorded orders, unless otherwise indicated.

6.7. Right of withdrawal

The right of withdrawal provided for in Article 6 of these general terms and conditions applies to pre-orders only from the date the customer actually receives the product. The fourteen (14) day period therefore begins to run from the date of delivery of the product, and not from the date of pre-order validation.

6.8. Modification or cancellation by MizouTCG

In the event of cancellation of the product release by the manufacturer or publisher, or in the event of MizouTCG's definitive inability to obtain the product, the customer will be fully refunded the amounts paid within fourteen (14) days of notification of the cancellation.

MizouTCG reserves the right to limit the number of pre-ordered products per customer and per product reference.

Article 7. Delivery

MizouTCG delivers to mainland France, Belgium, and other countries of the European Union. The applicable timescales and rates for each destination are indicated at the time of ordering. If the address to which the customer wishes to be delivered is not available in the delivery options, they must contact customer service.

Deliveries are made to the address indicated on the order form, which must be within the agreed geographical area. Orders are dispatched via our partner carriers (La Poste, Mondial Relay, or any other carrier suited to the destination), with a tracking service. Delivery timescales are given for information purposes only. In the event of a delivery delay exceeding 30 days, and following a formal notice that has remained without effect for 14 days, the customer may request cancellation of the order and a full refund. MizouTCG may provide the customer with their parcel tracking number by email.

The customer is required to check, in the presence of the La Poste representative or delivery person, the condition of the merchandise packaging and its contents upon delivery. In the event of damage during transit, any claim must be submitted to the carrier within three days of delivery.

7.1. Damaged or tampered parcel

⚠️ Important clause regarding delivery disputes

For any dispute related to a damaged or tampered parcel (damaged packaging, missing products, opened or altered parcel), the buyer is invited to send MizouTCG all relevant evidence as soon as possible, ideally within forty-eight (48) hours of receiving the parcel.

Evidence to be provided includes in particular:

  • Clear and detailed photographs of the outer packaging of the parcel showing visible damage
  • Photographs of the parcel contents (missing, damaged, or incorrect items)
  • A precise description of the anomalies observed (nature and extent of the damage)
  • A copy of the delivery note and/or the tracking slip
  • Any reservations made upon receipt with the carrier, if applicable

These items must be sent by email to mizoutcg34@gmail.com with the subject "DELIVERY DISPUTE - Order no. [order number]".

This prompt notification, ideally within forty-eight (48) hours of delivery, allows MizouTCG to pursue its claim against the carrier within the carrier's required timeframes. It facilitates the processing of the claim but does not constitute a condition of validity and in no way diminishes the customer's rights under the legal guarantees (items L. 217-3 and following of the French Consumer Code and items 1641 and following of the French Civil Code), which remain available under the conditions provided by law.

MizouTCG undertakes to process any admissible claim as promptly as possible and to provide an appropriate solution (replacement, refund, or compensation) after examining the evidence provided and, where applicable, opening a file with the carrier.

Article 8. Warranty

All products sold by MizouTCG benefit from the following legal guarantees, independent of any commercial warranty.

Legal guarantee of conformity (items L. 217-3 and following of the French Consumer Code)

The customer has a period of two (2) years from delivery of the goods to invoke the legal guarantee of conformity in the event of a conformity defect appearing. During this period, the customer is only required to establish the existence of the conformity defect, not the date on which it appeared.

The customer chooses between repair and replacement of the goods, subject to the cost conditions set out in item L. 217-12 of the French Consumer Code. The goods are repaired or replaced within thirty (30) days of the request, at no cost and without major inconvenience to the customer. If repair and replacement are impossible or cannot be implemented under the conditions provided by law, the customer may obtain a price reduction or dissolution of the sale (refund in exchange for return of the goods), unless the conformity defect is minor. The costs of returning and re-sending the non-conforming goods are borne by MizouTCG.

Warranty against hidden defects (items 1641 and following of the French Civil Code)

The customer may choose to invoke the warranty against hidden defects of the item sold within the meaning of item 1641 of the French Civil Code. The customer may then choose between dissolution of the sale and a reduction in the sale price, in accordance with item 1644 of the French Civil Code. The action resulting from hidden defects must be brought within two (2) years of discovery of the defect (item 1648 of the French Civil Code).

Article 9. Liability

MizouTCG, in the distance selling process, is bound only by an obligation of best efforts. Its liability cannot be engaged for damage resulting from the use of the internet network, such as data loss, intrusion, viruses, service interruption, or other unintentional issues.

Article 10. Intellectual property

All elements of the mizoutcg.fr website are and remain the exclusive intellectual property of MizouTCG. No one is authorised to reproduce, exploit, or use in any manner whatsoever, even partially, any elements of the website, whether in the form of photographs, logos, visuals, or text.

Article 11. Personal data

The provision of personal information collected for distance selling is mandatory, as this information is essential for processing and dispatching orders, and for issuing invoices and warranty contracts. Failure to provide this information results in the order not being validated. In accordance with the French Data Protection Act ("Informatique et Libertés"), the processing of customers' personal information has been declared to the French National Commission for Data Protection and Civil Liberties (CNIL). The customer has (under item 34 of the Act of 6 January 1978) the right to access, modify, correct, and delete data concerning them, which they may exercise with MizouTCG. A request may be submitted at any time by post to the following address: MizouTCG, 26 rue Bastard Senaux. Furthermore, MizouTCG undertakes not to communicate, free of charge or for consideration, its customers' contact details to any third party.

Article 12. Dispute resolution

These distance selling terms and conditions are governed by French law. In the event of a dispute, the consumer may refer the matter to the competent courts under the rules of common law. In accordance with item L. 612-1 of the French Consumer Code, in the event of an unresolved dispute, the customer may refer the matter free of charge to a consumer mediator.
